Navigating the Building Safety Regime

The building safety environment has become increasingly intricate, with significant legislative changes, planned amendments, and evolving safety protocols. At Centrick, we aim to simplify building safety, making it clear, transparent, and actionable.

Since the introduction of the Building Safety Act, a series of secondary legislations have emerged, requiring the industry to adapt significantly. Compliance is essential not only for regulatory adherence but also to ensure residents live in safe homes. Ongoing guidance and extensive remediation programs, particularly to replace unsafe cladding, are critical measures to prevent tragedies like the Grenfell Tower incident in June 2017.

Connor Scherer, Associate Director of Building Safety & Compliance, explained the significance of the Building Safety Act, saying:

“This act is groundbreaking in introducing significant reforms to enhance the rights, powers, and protections for residents and homeowners, ensuring safer homes nationwide. It provides extensive protections for qualifying leaseholders against the costs of rectifying historical building safety defects and offers a comprehensive set of measures to hold those responsible for these defects accountable. These changes collectively ensure that building owners will manage their properties better, and means that the home-building industry will have a clear and balanced framework to produce more high-quality homes. Our team are exceptionally well-versed in this change in legislation and are on-hand to assist developers, leaseholders and responsible persons as they adapt”

To help our clients, developers, resident management companies and dutyholders stay informed, team Centrick has created a free, downloadable guide to the Building Safety Regime. What is the Building Safety Regime?

But first, what exactly is the Building Safety Regime, and why has it been implemented?

Introduced in 2022, the Building Safety Act is the cornerstone of the Building Safety Regime. This Act introduces new requirements and reforms existing legislation, offering clarity on construction, maintenance, and safety protocols. It applies to all buildings, with additional stipulations for Higher-Risk Buildings, or HRBs. Transitional arrangements apply to HRBs and other buildings where initial notices or full plans were submitted to local authorities before October 1, 2023, with sufficient progress by April 6, 2024.

The Health and Safety Executive, or HSE, has launched a Building Safety Campaign titled ‘Making Buildings Safer: Your Home, Your Safety’ to help the industry understand these new requirements. There is a particular focus on higher risk buildings throughout the campaign, which are defined as residential buildings at least 18 meters tall, with seven or more stories, containing at least two residential units, or classified as hospitals or care homes.
